Richter Guitar respects the rights of songwriters, publishers, and other creators, and we expect everyone who uses this site to do the same. We respond to copyright complaints that follow the Digital Millennium Copyright Act (DMCA) and other applicable law.
If you believe something on richterguitar.com infringes a copyright you own or manage, this page explains what to send us and where. If material you posted was removed and you believe that was a mistake, it also explains how to ask for it to be restored.
Reporting infringement
Send a written notice to our designated copyright agent (contact details below). For the notice to be valid under the DMCA, it must include:
- Your physical or electronic signature, as the copyright owner or as someone authorized to act for the owner.
- A description of the copyrighted work you believe has been infringed. If several works are involved, a representative list is fine.
- A description of the material you believe is infringing, with enough detail for us to find it, such as the page URL.
- Your name, mailing address, phone number, and email address.
- This statement: I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- This statement: The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
When we receive a complete notice, we’ll act promptly to remove or disable access to the material. Where the material was posted by a user, we’ll make a good-faith effort to let that person know so they can respond. Notices that are missing required information may not be acted on.
Counter-notification
If material you posted was removed and you believe it was taken down by mistake or misidentification, you can send a counter-notification to the same agent. It must include:
- Your physical or electronic signature.
- A description of the material that was removed and where it appeared before removal.
- This statement: Under penalty of perjury, I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and phone number, plus a statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if you live outside the United States, any judicial district in which Richter Guitar may be found), and that you will accept service of process from the person who sent the original notice or their agent.
After receiving a valid counter-notification, we’ll forward a copy to the person who filed the original notice. If they don’t tell us within 10 to 14 business days that they’ve filed a court action to stop the activity, we may restore the material.
Please be accurate
Under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. If you’re unsure whether something infringes your rights, consider speaking with an attorney before sending a notice.
